Honestly the paragraph you cited would not prevent the GRE from being Open Source, but would prevent it from being Free Software.

But even still, I don't see this stipulation surviving very long. They would have to obtain consent for this action by every developer who has contributed code to the subset of Mozilla that is the GRE, since they agreed to liscense their work under the MPL/GPL. I don't think the MPL provided a loophole for this. If it did, then I think the shift to the GPL would not have required the consent of the developers since loophole would have worked here, too.

Then again, I may not know what I'm talking about.
